As Brazil looks to boost economic growth after Covid, knowledge-based industries will be key. These industries rely on intellectual property (IP) rights, especially a predictable and efficient patent system.
But May 2021’s decision by the Supreme Court to remove safeguards in the National Patent Law against unreasonable patent examination timelines puts the country’s IP system far below the standards of competitor countries.
As Brazil moves forward, how should it reform its patent examination system so that it offers innovators stability and predictability, and compares with the world’s best?
